(1) Subject to subsection (2), no action lies against the Territory or any person for damage to property resulting from enforcement of a fortification removal order involving the premises identified in the order.
(2) However, a registered proprietor of premises may recover the reasonable costs associated with repair or replacement of property damaged as a result of the creation of fortifications, or enforcement of a fortification removal order, as a debt from any person who caused the fortifications to be created.
