WORK HEALTH AND SAFETY (NATIONAL UNIFORM LEGISLATION) ACT 2011 - SECT 229C

    (1)     The court must review afresh the merits of the decision under review.

    (2)     In doing so the court is not bound by anything done by the regulator or internal reviewer.

    (3)     Without limiting subsection (2), the court may:

        (a)     consider evidence that was not considered by the regulator or internal reviewer; and

        (b)     disregard evidence that was considered by the regulator or internal reviewer.
