(1) If a person is a health and safety representative for a work group under Part 4, Division 3 of the old WHS Act immediately before commencement, on commencement the person becomes a health and safety representative for the work group under Part 5, Division 3, Subdivision 4 of this Act.
(2) The person's term of office under this Act is the remainder of the term for which he or she was elected under the old WHS Act.
(3) If an agreement or determination about a course of training for a health and safety representative was in force under section 42(3)(b) of the old WHS Act immediately before commencement, on commencement the course is taken to have been chosen by the representative for section 72(1)(c) of this Act.
(4) For sections 85(6) and 90(4), a person who becomes a health and safety representative for this Act under subsection (1) is taken to have completed initial training prescribed by the Regulations referred to in section 72(1)(b).
(5) Subsection (4) and this subsection expire 1 year after commencement.
