CHARLES DARWIN UNIVERSITY AMENDMENT ACT 2005 (NO 31 OF 2005) - SECT 7

Amendment of section 11 (Vacation or termination of office)

(1)     Section 11(1)(j) –

omit, substitute

    (j)     the member is disqualified from acting as a Director of a company or managing corporations under Part 2D.6 of the Corporations Act 2001 .

(2)     Section 11(2) –

omit, substitute

(2)     Subject to subsection (2A), the Council may terminate a member's appointment if it is satisfied that the member has not carried out his or her duties under section 10A.

(2A)     The Council can only exercise its power under subsection (2) if at least two-thirds of the members of the Council agree at a meeting that the member has not carried out his or her duties under section 10A.
