Northern Territory Numbered Acts Northern Territory Numbered Acts(1) A person who is given a direction under section 188 must comply with the requirements of the direction.
(2) A person commits an offence if the person:
(a) is given a direction under section 188 ; and
(b) fails to comply with the requirements of the direction or to have the holder of a licence carry out the work in accordance with the direction.
Maximum penalty: 100 penalty units.
(3) An offence against subsection (2) is an offence of strict liability.
(4) It is a defence to a prosecution for an offence against subsection (2) if the defendant did all that was reasonably practicable to comply, including engaging a contractor to perform the work.
(5) The defendant has a legal burden of proof in relation to the defence under subsection (4).
