2002 A BILL FOR An Act to amend the Agricultural Chemicals Distribution Control Act 1966 and the Chemical Usage (Agricultural and Veterinary) Control Act 1988

 


 

s1 6 s4 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Agricultural and Veterinary Chemicals 4 Legislation Amendment Bill 2002. 5 2 Commencement Clause 6 This Act commences on a day to be fixed by proclamation. 7 PART 2--AMENDMENT OF AGRICULTURAL 8 CHEMICALS DISTRIBUTION CONTROL ACT 1966 9 3 Act amended in pt 2 and sch 2 Clause 10 This part and schedule 2 amend the Agricultural Chemicals Distribution 11 Control Act 1966. 12 4 Amendment of s 6 (Definitions) Clause 13 (1) Section 6, `In this Act--'-- 14 omit, insert-- 15 `The dictionary in the schedule defines particular words used in this 16 Act.'. 17 (2) Section 6, definition "agricultural chemical product"-- 18 omit. 19 (3) Section 6-- 20 insert-- 21

 


 

s5 7 s5 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 ` "agricultural chemical product" see the Agvet Code, section 3. 1 "chemical product" see the Agvet Code, section 3. 2 "distinguishing number", for a chemical product, means a number, 3 together with 1 or more letters or symbols, given to the product on its 4 registration by the NRA. 5 "distribution contractor" means an aerial distribution contractor or 6 ground distribution contractor. 7 "ground distribution contractor" means a person who carries on the 8 business of ground distribution or at whose direction or on whose 9 authority, ground equipment is used to carry out ground distribution. 10 "information notice", for a decision of the chief executive or board under 11 this Act, means a notice stating-- 12 (a) the decision; and 13 (b) the reasons for the decision; and 14 (c) that the person given the notice may appeal against the decision 15 within 28 days after the notice is given; and 16 (d) how the person may appeal. 17 "NRA" see the Agvet Code, section 3. 18 "pest management technician" see the Pest Management Act 2001, 19 schedule 3. 20 "pest management qualification" see the Pest Management Act 2001, 21 schedule 3.'. 22 (4) Section 4, definitions, as amended-- 23 relocate to the schedule as inserted by this Act. 24 5 Amendment of s 6A (Words and expressions used in Agvet Code Clause 25 and this Act) 26 Section 6A-- 27 insert-- 28 `(2) Words and expressions mentioned in subsection (1) that are 29 expressly defined in section 3 of the Agvet Code are also signposted in the 30 dictionary.'. 31

 


 

s6 8 s7 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 6 Insertion of new ss 16A and 16B Clause 1 Part 4-- 2 insert-- 3 `16A When pest management technician is taken to hold commercial 4 operator's licence 5 `(1) For a provision of this Act relating to ground distribution, a pest 6 management technician who holds a relevant pest management 7 qualification is taken to hold a commercial operator's licence. 8 `(2) Sections 20 to 23 apply, with necessary changes, to the operation, 9 under this Act, of the pest management technician's licence as if it were a 10 commercial operator's licence. 11 `(3) For subsection (2), a reference in sections 20 to 23 to the suspension 12 or cancellation of a commercial operator's licence is taken to be a reference 13 to the suspension or cancellation of the operation of the pest management 14 technician's licence under this Act as a commercial operator's licence. 15 `(4) In subsection (1)-- 16 "relevant pest management qualification" means a qualification 17 prescribed for the subsection under a regulation. 18 `16B Ground distribution contractor licence 19 `The board may grant a ground distribution contractor's licence.'. 20 7 Amendment of s 17 (Application for licences) Clause 21 (1) Section 17(1)(a), `standards officer'-- 22 omit, insert-- 23 `board'. 24 (2) Section 17(4)-- 25 omit, insert-- 26 `(4) If the board decides to grant the application, the board must, as soon 27 as practicable, issue a licence to the applicant. 28

 


 

s8 9 s8 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 `(5) The board may grant an application for a pilot chemical rating 1 licence or commercial operator's licence only if the board is satisfied the 2 applicant is at least 17 years of age. 3 `(6) If the board decides to refuse to grant the application, the board 4 must, as soon as practicable-- 5 (a) give the applicant an information notice about the decision; and 6 (b) refund the fee mentioned in subsection (1)(b).'. 7 8 Replacement of ss 18 and 19 Clause 8 Sections 18 and 19-- 9 omit, insert-- 10 `18 Term of licence 11 `(1) A licence has effect from the day it is issued. 12 `(2) The board may issue, or renew, a licence for up to 3 years. 13 `19 Renewal of licence 14 `(1) A licensee may apply to the board to renew a licence within 60 days 15 before the licence expires. 16 `(2) If the board does not receive an application to renew a licence by the 17 day the licence is to expire, the licence expires. 18 `(3) The application must be-- 19 (a) made in the approved form; and 20 (b) accompanied by the fee prescribed under a regulation. 21 `(4) The applicant must give the board any relevant information or 22 document the board reasonably requires to decide the application. 23 `(5) The board must consider the application and either grant, or refuse 24 to grant, the application. 25 `(6) If the board decides to grant the application, the board must, as soon 26 as practicable, issue a new licence to the applicant. 27 `(7) The new licence takes effect from the day the licence being renewed 28 would otherwise have expired. 29

 


 

s9 10 s9 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 `(8) If the board decides to refuse to grant the application, the board 1 must, as soon as practicable-- 2 (a) give the applicant an information notice about the decision; and 3 (b) refund the fee mentioned in subsection (3)(b). 4 `19A Expiring licence continues in force 5 `(1) If a licensee has applied, under section 19, to renew a licence, the 6 licence continues in force from the day it would, apart from this section, 7 have expired until-- 8 (a) if the application is granted--a new licence is issued to the 9 applicant; or 10 (b) if the application is withdrawn--the day the application is 11 withdrawn; or 12 (c) if the application is refused--the day the information notice 13 about the decision is given to the applicant. 14 `(2) Subsection (1) does not apply if the licence is earlier suspended or 15 cancelled. 16 `19B Notice of change in circumstances 17 `(1) Subsection (2) applies if there is a change of the following type in a 18 licensee's circumstances-- 19 (a) a change in the licensee's name or address; 20 (b) another change in the licensee's circumstances prescribed under 21 a regulation. 22 `(2) The licensee must, within 21 days after the change, give the board 23 written notice of the change. 24 Maximum penalty--10 penalty units.'. 25 9 Amendment of s 21 (Cancellation or suspension of licence) Clause 26 (1) Section 21(1)(a), `section' to `made under'-- 27 omit, insert-- 28

s 26 19 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 `(2) However, subsection (1) does not allow a use-- 1 (a) contrary to a restraint statement on the label other than to treat a 2 single animal; or 3 (b) by injection unless the label gives instructions for use by 4 injection. 5 `12B Use by veterinary surgeon on major trade species animals 6 `(1) A veterinary surgeon may use, or prescribe, supply or recommend a 7 registered veterinary chemical product for use other than in a way stated in 8 the instructions on the approved label for containers for the product, to 9 treat-- 10 (a) if instructions for use on a major trade species animal are 11 mentioned on the label--any major trade species animals; or 12 (b) if there are no instructions for use on a major trade species 13 animal mentioned on the label--a single major trade species 14 animal. 15 `(2) Subsection (1) applies only to animals under the care of the 16 veterinary surgeon. 17 `(3) However, subsection (1) does not allow a use-- 18 (a) contrary to a restraint statement on the label other than to treat a 19 single animal; or 20 (b) by injection unless the label gives instructions for use by 21 injection. 22 `12C Supply by veterinary surgeon to others 23 `(1) A veterinary surgeon may supply a registered veterinary chemical 24 product that is not packed and labelled in the way stated in the Agvet 25 Code-- 26 (a) for an animal under the care of the veterinary surgeon; or 27 (b) to another veterinary surgeon in the same veterinary practice. 28 `(2) However, subsection (1)(b) applies only if a pharmacologically 29 equivalent registered veterinary chemical product with instructions for use 30 for the particular animal species being treated is not reasonably available in 31 the particular circumstances. 32

 


 

s 26 20 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 `12D Use by other persons in way stated in veterinary surgeon's 1 instructions 2 `(1) A person, other than a veterinary surgeon, may use a registered 3 veterinary chemical product, other than in a way stated in the instructions 4 on the approved label for containers for the product if the person uses the 5 product in the way stated in written instructions given by the veterinary 6 surgeon who prescribed, supplied or recommended the product. 7 `(2) However, subsection (1) does not allow a use-- 8 (a) contrary to a restraint statement on the label other than to treat a 9 single animal; or 10 (b) by injection unless the label gives instructions for use by 11 injection. 12 `Subdivision 2--Unregistered veterinary chemical products 13 `12E Use of unregistered veterinary chemical products 14 `(1) A veterinary surgeon must not use, or prescribe, supply or 15 recommend an unregistered veterinary chemical product for use to treat an 16 animal. 17 Maximum penalty for subsection (1)--600 penalty units. 18 `(2) Subsection (1) does not apply if the product is used, or prescribed, 19 supplied or recommended for use in a way authorised by a permit or 20 prescribed under a regulation. 21 `(3) It is a defence to a prosecution for an offence against subsection (1) 22 to prove the product was used, or prescribed, supplied or recommended for 23 use in a way authorised under section 12F or 12G. 24 `(4) A person, other than a veterinary surgeon, must not use an 25 unregistered veterinary chemical product to treat an animal. 26 Maximum penalty for subsection (4)--600 penalty units. 27 `(5) Subsection (4) does not apply if the product is used in a way 28 authorised by a permit or prescribed under a regulation. 29 `(6) It is a defence to a prosecution for an offence against subsection (4) 30 to prove the product was used in a way authorised under section 12H. 31

 


 

s 26 21 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 `(7) It is also a defence to a prosecution for an offence against 1 subsection (1) or (4) to prove-- 2 (a) the product was a registered veterinary chemical product at some 3 time in the 2 years immediately before its use by the defendant; 4 and 5 (b) the product's registration ended under section 47(2) or (3) of the 6 Agvet Code; and 7 (c) the defendant's use of the product did not contravene an 8 instruction that appeared on the approved label for containers for 9 the product immediately before the product's registration ended; 10 and 11 (d) the label was attached to the product's container immediately 12 before the product was taken from the container. 13 `(8) This section is an eligible law for the definition `permit' under 14 section 109 of the Agvet Code. 15 `12F Use by veterinary surgeon 16 `(1) A veterinary surgeon may use, or prescribe, supply or recommend 17 an unregistered veterinary chemical product for use to treat-- 18 (a) animals other than trade species animals; or 19 (b) a single trade species animal. 20 `(2) Subsection (1) applies only to animals under the care of the 21 veterinary surgeon. 22 `12G Supply by veterinary surgeon to others 23 `(1) A veterinary surgeon may supply an unregistered veterinary 24 chemical product to another veterinary surgeon in the same veterinary 25 practice. 26 `(2) However, subsection (1) applies only if a pharmacologically 27 equivalent registered veterinary chemical product with instructions for use 28 for the particular animal species being treated is not reasonably available in 29 the particular circumstances. 30

s 26 23 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 (b) a single trade species animal. 1 `(2) Subsection (1) applies only to animals under the care of the 2 veterinary surgeon. 3 `12K Supply by pharmacist 4 `A pharmacist may supply a compounded veterinary chemical product in 5 a quantity needed for a single course of treatment. 6 `12L Use by other persons in way stated in written instructions 7 `A person, other than a veterinary surgeon, may use a compounded 8 veterinary chemical product to treat an animal in the way stated in written 9 instructions given by-- 10 (a) the veterinary surgeon who prescribed, supplied or 11 recommended the product; or 12 (b) the pharmacist who supplied the product. 13 `Subdivision 4--Information to be given by veterinary surgeon or 14 pharmacist about the treatment of an animal 15 `12M Information to be given by veterinary surgeon or pharmacist 16 `(1) This section applies to-- 17 (a) a veterinary surgeon who uses, or prescribes, supplies or 18 recommends a veterinary chemical product or compounded 19 veterinary chemical product for use to treat an animal under the 20 care of the veterinary surgeon; or 21 (b) a pharmacist who supplies a compounded veterinary chemical 22 product under a prescription given by a veterinary surgeon to 23 treat an animal. 24 `(2) The veterinary surgeon or pharmacist must give to the person in 25 charge of the animal at the time of the treatment full and appropriate 26 instructions about the treatment including the instructions mentioned in 27 section 12N. 28 Maximum penalty for subsection (2)--300 penalty units. 29

 


 

s 26 24 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 `(3) For subsection (2), the instructions-- 1 (a) must be in writing, which may include the instructions on the 2 approved label for containers for the product (the "label 3 instructions"); and 4 (b) must explain whether or not the label instructions form part of 5 the instructions; and 6 (c) must include an explanation of the meaning of the instructions 7 including the meaning of the label instructions that are equivalent 8 to the matters mentioned in section 12N; and 9 (d) for a registered veterinary chemical product to be used other than 10 in a way stated in the label instructions--must include an 11 explanation of the extent to which the label instructions do not 12 form part of the instructions. 13 `(4) Subsection (2) applies to the treatment of an animal other than a 14 trade species animal only if the treatment involves the use of-- 15 (a) a registered veterinary chemical product other than in a way 16 stated in the label instructions; or 17 (b) a veterinary chemical product that is a prescription animal 18 remedy; or 19 (c) an unregistered veterinary chemical product; or 20 (d) a compounded veterinary chemical product. 21 `(5) If the person who receives the instructions mentioned in 22 subsection (2) is not usually in charge of the animal, the person must give 23 the instructions to the person usually in charge of the animal when that 24 person again becomes in charge of the animal. 25 Maximum penalty for subsection (5)--100 penalty units. 26 `12N Information to be included in instructions 27 `(1) For treatment of a trade species animal, the instructions mentioned 28 in section 12M must include-- 29 (a) whether there is a withholding period for use of the product and 30 the length of the period; and 31

 


 

s 26 25 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 (b) for a registered veterinary chemical product--particulars to 1 identify the product and, if the product has a distinguishing 2 number, the number; and 3 (c) for a product other than a registered veterinary chemical 4 product--particulars to identify the product; and 5 (d) the name of the product's active constituent; and 6 (e) the dosage; and 7 (f) the frequency of the dosage; and 8 (g) the treatment period; and 9 (h) how the product is to be used to treat the animal; and 10 (i) the species of animal to be treated; and 11 (j) details to identify the particular animal; and 12 (k) the date the product was used, prescribed, supplied or 13 recommended for use; and 14 (l) the expiry date of the product; and 15 (m) the name and address of the veterinary surgeon or pharmacist 16 who gave the instructions; and 17 (n) the name and address of the person to whom the product is 18 supplied; and 19 (o) for a recommendation, the period the recommendation is to 20 apply; and 21 (p) other information prescribed under a regulation. 22 `(2) For treatment of an animal other than a trade species animal, the 23 instructions mentioned in section 12M must include the matters mentioned 24 in subsection (1)(b) to (p). 25 `12O Instructions must be kept 26 `A person given instructions under section 12M, for treatment of trade 27 species animals, must keep the instructions for-- 28 (a) the period prescribed under a regulation; or 29 (b) if no period is prescribed--2 years. 30 Maximum penalty--100 penalty units. 31

 


 

s 26 26 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 `Subdivision 5--Information to be given by person other than veterinary 1 surgeon or pharmacist 2 `12P Information to be given to person in charge of animal 3 `(1) This section applies to a person, other than a person mentioned in 4 subsection (4), who uses a veterinary chemical product or compounded 5 veterinary chemical product to treat a trade species animal. 6 `(2) The person must give the person in charge of the animal at the time 7 of the treatment, full and appropriate written advice about the treatment 8 including any written instructions given by a veterinary surgeon or 9 pharmacist. 10 Maximum penalty for subsection (2)--300 penalty units. 11 `(3) If the person who receives the advice is not usually in charge of the 12 animal, the person must give the advice to the person usually in charge of 13 the animal when that person again becomes in charge of the animal. 14 Maximum penalty for subsection (3)--100 penalty units. 15 `(4) This section does not apply to-- 16 (a) a veterinary surgeon; or 17 (b) the person usually in charge of the animal; or 18 (c) an employee of the person usually in charge of the animal who 19 uses the product in the course of the employment. 20 `12Q Information to be included in written advice 21 `(1) The written advice mentioned in section 12P must include-- 22 (a) whether there is a withholding period for use of the product and 23 the length of the period; and 24 (b) for a registered veterinary chemical product--particulars to 25 identify the product and, if the product has a distinguishing 26 number, the number; and 27 (c) for a product other than a registered veterinary chemical 28 product--particulars to identify the product; and 29 (d) the name of the product's active constituent; and 30 (e) the dosage; and 31

 


 

s 26 27 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 (f) the frequency of the dosage; and 1 (g) the treatment period; and 2 (h) how the product was used to treat the animal; and 3 (i) the species of animal treated; and 4 (j) details to identify the particular animal; and 5 (k) the date the product was used; and 6 (l) the name and address of the person using the product; and 7 (m) the name and address of the person usually in charge of the 8 animal; and 9 (n) any other information prescribed under a regulation. 10 `(2) Subsection (3) applies to-- 11 (a) a person mentioned in section 12P(1); and 12 (b) a person usually in charge of an animal, who receives written 13 advice under section 12P(2) or (3). 14 `(3) Each person mentioned in subsection (2) must keep a copy of the 15 advice for-- 16 (a) the period prescribed under a regulation; or 17 (b) if no period is prescribed--2 years. 18 Maximum penalty for subsection (3)--100 penalty units. 19 `Subdivision 6--Records to be kept 20 `12R Records to be kept by veterinary surgeon 21 `(1) This section applies to a veterinary surgeon who uses, or prescribes, 22 supplies or recommends for use, to treat a trade species animal any of the 23 following-- 24 (a) a registered veterinary chemical product to be used other than in 25 a way stated in the instructions on the approved label for 26 containers for the product; 27 (b) a veterinary chemical product that is a prescription animal 28 remedy; 29

s 26 29 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 (b) if no period is prescribed--2 years. 1 Maximum penalty for subsection (3)--200 penalty units. 2 `Subdivision 7--Withholding period 3 `12S Meaning of "withholding period" 4 The "withholding period", for use of a chemical product or 5 compounded veterinary chemical product, is the minimum period that must 6 elapse between the last use of the product and-- 7 (a) for a use in relation to a crop or pasture--the harvesting or 8 cutting of, or the grazing of animals on, the crop or pasture; or 9 (b) for a use in relation to an animal, including the feeding of an 10 animal on feed treated with the product--the shearing or 11 slaughtering of the animal, or the collection of milk or eggs from 12 the animal for human consumption. 13 `12T Identification of animals to which withholding period applies 14 `(1) This section applies to a person in charge of a trade species animal 15 if-- 16 (a) a veterinary chemical product or compounded veterinary 17 chemical product is used to treat the animal; and 18 (b) a withholding period applies to the use of the product. 19 `(2) The person must take reasonable steps to ensure the animal is 20 identifiable as an animal mentioned in subsection (1) during-- 21 (a) the treatment period; and 22 (b) the withholding period. 23 24 Examples for subsection (2)-- 25 1. s 26 30 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 `12U Notice of treatment on supply of trade species animal 1 `(1) This section applies to a person who supplies a trade species animal 2 to another person if-- 3 (a) a veterinary chemical product or compounded veterinary 4 chemical product was used to treat the animal; and 5 (b) a withholding period applies to the use of the product and the 6 period has not elapsed. 7 `(2) The person must give the other person written notice of the 8 treatment including-- 9 (a) the withholding period for use of the product or the date the 10 withholding period elapses; and 11 (b) the name of-- 12 (i) the product used; or 13 (ii) if the product does not have a name--the product's active 14 constituent; and 15 (c) details to identify the particular animal; and 16 (d) the date of the treatment; and 17 (e) other information prescribed under a regulation. 18 Maximum penalty for subsection (2)--300 penalty units. 19 `(3) Subsection (4) applies to-- 20 (a) a person mentioned in subsection (1); and 21 (b) a person who receives written notice under subsection (2). 22 `(4) Each person mentioned in subsection (3) must keep a copy of the 23 notice for-- 24 (a) the period prescribed under a regulation; or 25 (b) if no period is prescribed--2 years. 26 Maximum penalty for subsection (4)--100 penalty units. 27 `12V Observance of withholding period 28 `(1) This section applies to a person in charge of a trade species animal 29 if-- 30

 


 

s 26 31 s 26 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 (a) a veterinary chemical product or compounded veterinary 1 chemical product has been used to treat the animal; and 2 (b) a withholding period applies to the use of the product. 3 `(2) The person must not, within the withholding period, allow the 4 animal to be shorn or slaughtered or milk or eggs to be collected from the 5 animal, for human consumption. 6 Maximum penalty for subsection (2)--600 penalty units. 7 `Division 3--Agricultural chemical products 8 `13 Use of registered agricultural chemical products in contravention 9 of labels 10 `(1) A person must not use a registered agricultural chemical product 11 other than in a way stated in the instructions on the approved label for 12 containers for the product. 13 Maximum penalty for subsection (1)--600 penalty units. 14 `(2) Subsection (1) does not apply if the product is used in a way 15 authorised by a permit or prescribed under a regulation. 16 `(3) It is a defence to a prosecution for an offence against subsection (1) 17 to prove the product was used in a way authorised under section 13B. 18 `(4) This section is an eligible law for the definition `permit' under 19 section 109 of the Agvet Code. 20 `13A Use of unregistered agricultural chemical products 21 `(1) A person must not use an agricultural chemical product unless it is a 22 registered agricultural chemical product. 23 Maximum penalty for subsection (1)--600 penalty units. 24 `(2) Subsection (1) does not apply if-- 25 (a) the product is used in a way authorised by a permit; or 26 (b) the product is prescribed for this subsection under a regulation. 27 `(3) It is a defence to a prosecution for an offence against subsection (1) 28 to prove-- 29

s 31 34 s 31 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 "distinguishing number", for a chemical product, means a number, 1 together with 1 or more letters or symbols, given to the product on its 2 registration by the NRA. 3 "expiry date"-- 4 (a) for a compounded veterinary chemical product--means the date 5 the product's treatment period ends; and 6 (b) otherwise--see the Agvet Code, section 3. 7 "food-producing species" has the meaning given by the Agvet Code but 8 does not include a horse. 9 "in charge", of an animal-- 10 1. A person is in charge of an animal if the person-- 11 (a) owns or has a lease, licence or other proprietary interest in 12 the animal; or 13 (b) has custody of the animal. 14 2. However, a person who holds a mortgage or other security 15 interest in an animal becomes in charge of the animal only if the 16 person takes a step to enforce the mortgage or other security. 17 "major trade species animal" means a trade species animal that is one of 18 the following-- 19 (a) cattle, sheep, pigs or domestic fowl (Gallus domesticus); 20 (b) another trade species animal declared under a regulation to be a 21 major trade species animal. 22 "maximum residue limit" means the following-- 23 (a) for the residue of a chemical in or on agricultural produce or 24 manufactured stock food--the maximum residue limit prescribed 25 under a regulation; 26 (b) for chemical or antibiotic residue in trade species animals or 27 products derived from trade species animals--the maximum 28 residue limit prescribed under the Stock Act 1915 for the tissue of 29 stock or a product of stock. 30 "NRA" see the Agvet Code, section 3. 31 "pharmacist" means a general registrant within the meaning of the 32 Pharmacists Registration Act 2001. 33

 


 

s 31 35 s 31 Agricultural and Veterinary Chemicals Legislation Amendment Bill 2002 "prescription animal remedy" means a chemical product that is an 1 S4 poison under the Health (Drugs and Poisons) Regulation 1996. 2 "registered agricultural chemical product" means an agricultural 3 chemical product that is a registered chemical product. 4 "registered veterinary chemical product" means a veterinary chemical 5 product that is a registered chemical product. 6 "restraint statement" means a statement, on a product's label, usually 7 under the heading `restraints', about the situations in which use of the 8 product is restricted. 9 10 Examples of the starting words of a restraint statement-- 11 1. `For use only by or under'. 12 2. `Do not use'. 13 3. `Not to be used'. 14 4. `Use only'. "single", for treatment of an animal, means-- 15 (a) the animal is on its own; or 16 (b) the animal is from a group of animals in which no other animal in 17 the group, or on the same property, is treated in the same way. 18 "supply" see the Agvet Code, section 3. 19 "trade species animal" means-- 20 (a) a food-producing species; or 21 (b) an animal kept or used for trading in products derived from the 22 animal, for example wool, feathers, skin or bone. 23 "unregistered veterinary chemical product" means a veterinary 24 chemical product that is not a registered veterinary chemical product, 25 and includes, for example-- 26 (a) a human pharmaceutical product; and 27 (b) a chemical product intended for use as an agricultural chemical 28 product. 29 "veterinary chemical product" see the Agvet Code, section 3. 30 "withholding period" see section 12S.'. 31
