s1 6 s4 Primary Industries Legislation Amendment (No. 2) The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Primary Industries Legislation 4 Amendment Act (No. 2) 1997. 5 6 Commencement Clause 2. This Act commences on a day to be fixed by proclamation. 7 ART 2--AMENDMENT OF DAIRY INDUSTRY ACT 8 P 1993 9 amended in pt 2 10 Act Clause 3. This part amends the Dairy Industry Act 1993. 11 of s 45 (Offences related to licences) 12 Amendment Clause 4. Section 45(2), after `a processor'-- 13 insert-- 14 `of market milk'. 15

The Deer Farming Act 1985 is repealed. 3 PART 4--AMENDMENT OF EXOTIC DISEASES IN 4 ANIMALS ACT 1981 5 amended in pt 4 6 Act Clause 6. Section 30-- 12 omit, insert-- 13 for compensation 14 `Claims `30.(1) An owner may apply to the chief executive for an assessment of 15 compensation within 90 days after the destruction of the animal or property 16 or the death of the animal. 17 `(2) The amount of compensation payable is-- 18 (a) for an animal-- 19 (i) if the destroyed or dead animal was affected with an exotic 20 disease--the animal's market value immediately before it 21 was affected; or 22 (ii) if the destroyed animal was not affected with an exotic 23 disease--the animal's market value immediately before it 24 was destroyed; or 25 (b) for property--the property's market value immediately before it 26 was destroyed. 27
s 22 12 s 23 Primary Industries Legislation Amendment (No. 2) `(3) If, when the quarantine ends under section 9(1B), the market value 1 of the animal or property is more than the amount of compensation paid 2 under an application under subsection (1), the owner may apply for 3 additional compensation, within 30 days after the quarantine ends. 4 `(4) The amount of additional compensation payable is the difference 5 between the amount of compensation paid under the application under 6 subsection (1) and the market value of the animal or property immediately 7 after the quarantine is revoked. 8 `(5) Despite any other Act, the State is not liable to pay compensation 9 under the other Act for an animal or property for which compensation has 10 been, or may be, paid under this Act. 11 `(6) In this section-- 12 "market value"-- 13 (a) means the market value of the animal or property calculated on a 14 sale with delivery-- 15 (i) if the animal or property was ordered to be destroyed--at the 16 place where the animal or property is when ordered to be 17 destroyed; or 18 (ii) if no order was made--at the place where the animal died; 19 but 20 (b) does not include an allowance for loss of profit, loss caused by 21 breach of contract or award, loss of production or any other 22 consequential loss.'. 23 of s 32 (Basis of compensation) 24 Omission Clause 22. s 25 14 s 28 Primary Industries Legislation Amendment (No. 2) ART 5--AMENDMENT OF FISHERIES ACT 1994 1 P amended in pt 5 2 Act Clause 25. This part amends the Fisheries Act 1994. 3 of s 4 (Definitions) 4 Amendment Clause 26. Section 4-- 5 insert-- 6 ` "VMS equipment" means equipment used as part of a system that 7 monitors the position and operation of a vessel.'. 8 of s 36 (What management plan may deal with) 9 Amendment Clause 27. Section 36, example 5, at the end-- 10 insert-- 11 `which may include, for example, a requirement to install, maintain and use VMS 12 13 equipment'. of s 46 (Emergency fisheries declarations) 14 Amendment Clause 28. Section 46(9)-- 15 omit, insert-- 16 `(9) The following sections of the Statutory Instruments Act 1992 apply 17 to an emergency fisheries declaration as if it were subordinate legislation-- 18 (a) section 49 (Subordinate legislation must be tabled); 19 (b) section 50 (Disallowance); 20 (c) section 51 (Limited saving of operation of subordinate legislation 21 that ceases to have effect).'. 22

Section 184-- 7 insert-- 8 `(5) A certificate purporting to be signed by a person mentioned in 9 subsection (3) stating that, at a stated time on a stated day, the person, using 10 equipment prescribed under a regulation, located a signal coming from the 11 VMS equipment for a stated boat at a stated place is evidence that the boat 12 was at the place at the time. 13 `(6) In this section-- 14 "VMS equipment for a stated boat" means the VMS equipment 15 required by an authority to be carried on the stated boat.'. 16 PART 6--AMENDMENT OF FRUIT MARKETING 17 ORGANISATION ACT 1923 18 amended in pt 6 19 Act Clause 31. s 35 17 s 37 Primary Industries Legislation Amendment (No. 2) of assets, rights and liabilities of deciduous group committee 1 `Vesting `20.(1) On a date prescribed under a regulation, the assets, rights and 2 liabilities of the deciduous group committee vest in the following 3 committees in the proportions prescribed under a regulation-- 4 (a) the tomato group committee; 5 (b) the heavy produce group committee; 6 (c) the other fruits group committee; 7 (d) the vegetable group committee. 8 `(2) This section expires 1 year after it commences.'. 9 ART 7--AMENDMENT OF PRIMARY 10 P PRODUCERS' ORGANISATION AND MARKETING 11 ACT 1926 12 amended in pt 7 13 Act Clause 35. This part amends the Primary Producers' Organisation and 14 Marketing Act 1926. 15 of s 12 (Boards not to be concerned in party politics) 16 Amendment Clause 36. s 38 18 s 38 Primary Industries Legislation Amendment (No. 2) (3) Section 30(5C)-- 1 insert-- 2 `(f) provide that a person elected as a member of the mill suppliers' 3 committee for a prescribed mill is taken also to be a member of 4 the district cane growers' executive for the mill.'. 5 (4) Section 30-- 6 insert-- 7 `(5F) In addition to the elected members, the elected representatives on 8 the district cane grower's executive for the mill are members of the 9 committee by virtue of office.'. 10 of new pt 10 11 Insertion Clause 38. s 38 19 s 38 Primary Industries Legislation Amendment (No. 2) Commercial Fishermen's Organisation Regulation 1989 to-- 1 (a) a Master Fisherman's Licence, or a Master Fisherman's Licence 2 issued under the former Act, is taken to be a reference to-- 3 (i) a master fisherman's licence issued under the former Act3 4 continued in force as an authority or renewed under the 5 Fisheries Act 1994;4 or 6 (ii) a commercial fisher licence issued under the Fisheries Act 7 1994;5 or 8 (b) a Queensland Commercial Fishing Vessel Licence, or a 9 Queensland Commercial Fishing Vessel Licence (endorsed as a 10 primary vessel with one or more fishery entitlements) issued 11 under the former Act, is taken to be a reference to-- 12 (i) a commercial fishing vessel licence issued under the former 13 Act6 continued in force as an authority or renewed under the 14 Fisheries Act 1994 with 1 or more fishery symbols written 15 on it; or 16 (ii) a primary commercial fishing boat licence, or a tender 17 commercial fishing boat licence, issued under the Fisheries 18 Act 1994 with 1 or more fishery symbols written on it. 19 `(2) In subsection (1)-- 20 "former Act" means the Fishing Industry Organisation and Marketing Act 21 1982.'. 22 3 See the Fishing Industry Organisation and Marketing Regulation 1991, section 7 (Master Fisherman's licence). 4 See the Fisheries Act 1994, expired section 233 (Existing licences etc.). 5 For licences issued under the Fisheries Act 1994, see the Fisheries Regulation 1995 section 31 (Licences Authority may issue). 6 See the Fishing Industry Organisation and Marketing Regulation 1991, section 9 (Fishing vessel licences).
