The Parliament of Queensland enacts-- 1
PART 1--PRELIMINARY 2
1 Short title

This Act may be cited as the Police Service Administration Amendment 4
Act 2002. 5

This part amends the Police Service Administration Act 1990. 9

Part 5, after section 5.16-- 11
insert-- 12
`5.17 Withdrawal of services 13
`(1) An officer must not-- 14
(a) withdraw from his or her duties, whether as a constable or 15
otherwise, unless authorised by-- 16
(i) this Act; or 17
(ii) a regulation; or 18
(iii) the commissioner; or 19
(b) engage in conduct that, if engaged in by 2 or more officers, 20
would be a strike as defined under the Industrial Relations Act 21
1999. 22
Maximum penalty--100 penalty units. 23

`(2) Subsection (1) has effect for all officers, and in particular has effect 1
despite section 5.15(b) and the Industrial Relations Act 1999. 2
`(3) It is declared that an authorisation mentioned in subsection (1)(a) 3
can not authorise an officer to engage with another or other officers in 4
conduct mentioned in subsection (1)(b).'. 5

`11.3 Withdrawal of services always prohibited 13
`(1) It is declared that section 5.3 of the Police Service Administration 14
Regulation 1990 as in force before the commencement of this section was, 15
at all times after its making and before the commencement, as valid and 16
effective as it would have been if-- 17
(a) it had been enacted in this Act when the regulation was made; 18
and 19
(b) it had been expressed to have effect despite any other law, in 20
particular the Industrial Law. 21
`(2) In this section-- 22
"Industrial Law" means-- 23
(a) the Industrial Relations Act 1990 as it was in force from time to 24
time; or 25
(b) the Workplace Relations Act 1997 as it was in force from time to 26
time; or 27
(c) the Industrial Relations Act 1999.'. 28
