Racing and Betting Amendment
BE IT ENACTED by the Queen's Most Excellent Majesty, by and with 1
the advice and consent of the Legislative Assembly of Queensland in 2
Parliament assembled, and by the authority of the same, as follows. 3

This Act may be cited as the Racing and Betting Amendment Act 5

The Racing and Betting Act 1980 is amended as set out in this Act. 8

Section 218(1)-- 11

`218.(1) This section applies to a person who contravenes section 214, 13
216 or 217. 14
`(1A) The person commits an offence that is a misdemeanour. 15
`(1B) For a first offence, the person is liable to-- 16
(a) subject to subsection (3), a minimum penalty of 300 penalty 17
units; and 18
(b) a maximum penalty of 400 penalty units. 19
`(1C) For a second offence, the person is liable to-- 20
(a) a minimum penalty of 401 penalty units; and 21
(b) a maximum penalty of 600 penalty units or imprisonment for 18 22
months. 23
`(1D) For a third or subsequent offence, the person is liable to-- 24
(a) a minimum penalty of 601 penalty units; and 25
(b) a maximum penalty of 1 000 penalty units or imprisonment for 5 26
years. 27

`(1E) Despite any other Act, if a court fines the person, the court must 1
order that the person be imprisoned if the fine is not paid. 2
`(1F) The term of imprisonment that the court must order under 3
subsection (1E) must be such that, in the court's opinion, will satisfy the 4
justice of the case, but must be-- 5
(a) if the person was liable to a fine under subsection (1B)--a term 6
of not less than 3 months and not more than 6 months; and 7
(b) if the person was liable to a fine under subsection (1C)--a term 8
of not less than 12 months and not more than 18 months; and 9
(c) if the person was liable to a fine under subsection (1D)--a term 10
of not less than 3 years and not more than 5 years.'. 11

(a) a person is convicted of an offence mentioned in subsection (1) 15
and it is the person's first offence against any provision of any of 16
the sections mentioned in subsection (1); and 17
(b) the court before whom the person is convicted considers that in 18
the particular case there are special circumstances that make it just 19
to do so; 20
the court may impose a penalty less than the minimum penalty mentioned 21
in subsection (1B) but not, in any case, less than 50 penalty units.'. 22
(3) Section 218(5)-- 23

`(5) A person is liable for the penalty under this section-- 25
(a) for a second offence--if the person has been convicted of a single 26
offence against any provision of any of the sections mentioned in 27
subsection (1); or 28

convicted of 2 or more offences against any provisions of any of 30
the sections mentioned in subsection (1).'. 31

Penalties and Sentences Act 1992) that would result in the person not 17
serving the sentence in prison. 18

Sentences Act 1992 then, until the commencement of that Part, references in 10
