2011 A Bill for An Act to facilitate the granting of a long-term lease over the Surat Basin rail corridor land by providing for the exclusion of certain leases from the application of particular provisions of the Land Title Act 1994 and the Property Law Act 1974

 


 

Surat Basin Rail (Long-term Lease) Bill 2011 [s 1] The Parliament of Queensland enacts-- 1 1 Short title 2 This Act may be cited as the Surat Basin Rail (Long-term 3 Lease) Act 2011. 4 2 Commencement 5 This Act commences on a day to be fixed by proclamation. 6 3 Meaning of Surat Basin rail corridor land 7 Surat Basin rail corridor land means land that is-- 8 (a) shown as `State Development Area' on a map in the 9 map series SBIC_1 to SBIC_93 and SBIC_95 to 10 SBIC_139 published by the department on 3 October 11 2011; and 12 (b) comprised in a State development area declared under 13 the State Development and Public Works Organisation 14 Act 1971, section 77. 15 Editors note-- 16 The map series is available for inspection at the office of the 17 Coordinator-General at 100 George Street, Brisbane. 18 4 Declaration of exempt lease 19 (1) The Minister may, by written instrument, declare a lease to be 20 an exempt lease if-- 21 (a) the lease is granted over the Surat Basin rail corridor 22 land or a part of the land; and 23 (b) the lease is primarily for the purpose of constructing or 24 operating a railway or rail transport infrastructure; and 25 (c) the lessor is-- 26 (i) the Coordinator-General; or 27 Page 4

 


 

Surat Basin Rail (Long-term Lease) Bill 2011 [s 5] (ii) the State. 1 (2) As soon as practicable after making the instrument, the 2 Minister must give a copy of it to the lessee. 3 (3) Within 21 days after making the instrument, the Minister must 4 publish a gazette notice setting out the declaration contained 5 in the instrument. 6 (4) Failure to comply with subsection (2) or (3) does not affect 7 the validity of the instrument. 8 (5) In this section-- 9 rail transport infrastructure see the Transport Infrastructure 10 Act 1994, schedule 6. 11 5 Non-application of provisions of Land Title Act 1994 and 12 Property Law Act 1974 13 The following provisions do not apply to a lease declared to 14 be an exempt lease under section 4-- 15 (a) the Land Title Act 1994, section 67(3)(a); 16 (b) the Property Law Act 1974, section 121 and part 8, 17 division 3. 18 © State of Queensland 2011 Page 5
