Explanatory Notes for amendments to be
moved during consideration in detail by the

Title of Bill
Aboriginal and Torres Strait Islander Land Holding Bill 2012
Objectives of the amendments
The amendments to be moved during consideration are to implement a
recommendation of the Agriculture, Resources and Environment Committee
in tabled Report No. 10 in relation to the Aboriginal and Torres Strait
Islander Land Holding Bill 2012. The recommendation being implemented
is that the Bill be amended to change the name of `community reference
panel' for a trust area to be the `Land Holding Act stakeholder reference
panel' to more accurately capture the composition of the panel and remove
any potential misconceptions about the representation on the panel or the
functions of the panel.
Achievement of the objectives
The objectives of the amendments are achieved by amendments to the Bill.
Alternative ways of achieving policy objectives
Legislative amendment is the only means of achieving the policy objectives.
Estimated cost for government implementation
The amendments do not change the estimated cost for government
implementation.
Consistency with fundamental legislative principles
The amendments are consistent with fundamental legislative principles.

Given the minor nature of the propose amendments and that these
amendments are the result of public consultation on the Bill by the
Agriculture, Resources and Environment Committee no further community
consultation has been undertaken.

Notes on Provisions
Amendment 1
Amendment 1 amends clause 13 (Establishment of community
reference panels) to change the reference on page 19, line 28 to
`community reference panel' to `Land Holding Act stakeholder reference
panel'.
Amendment 2
Amendment 2 amends clause 13 (Establishment of community
reference panels) to change the reference on page 19, line 29 to
`community reference panel' to `Land Holding Act stakeholder reference
panel'.
Amendment 3
Amendment 3 amends clause 13 (Establishment of community

Amendment 7 amends clause 30 (Minister refers lease entitlement
notice to community reference panel or reference entity) to change the
reference on page 31, line 27 to `community reference panel' to `Land
Holding Act stakeholder reference panel'.

Amendment 8 amends clause 30 (Minister refers lease entitlement

lease) to change the reference on page 47, line 5 to `community reference
panel' to `Land Holding Act stakeholder reference panel'.
Amendment 16
Amendment 16 amends clause 52 (Consultation about boundaries of
lease) to change the reference on page 47, line 8 to `community reference
panel' to `Land Holding Act stakeholder reference panel'.
Amendment 17
Amendment 17 amends the Schedule (Dictionary) to omit the definition
of `community reference panel' on page 111, lines 1 to 3.
Amendment 18
Amendment 18 amends the Schedule (Dictionary) to insert a definition
of `Land Holding Act stakeholder reference panel' on page 111, after line
26.
