If, but for this section—
(a) a worker is dismissed in circumstances entitling the worker to—(i) lodge a complaint with the commissioner under the Act ; and(ii) apply for industrial relief; and
(b) the worker does not apply for industrial relief before lodging a complaint and being notified under section 141 that the complaint has been accepted;the worker may only proceed with the complaint and may not later apply for industrial relief in respect of the circumstances.
