ANTI-DISCRIMINATION ACT 1991 - SECT 285
Existing representative complaints
285 Existing representative complaints
(1) This section applies in relation to a complaint accepted by the
commissioner before the commencement that, immediately before the
commencement— (a) was a representative complaint; and
(b) either— (i) was
still being dealt with by the commissioner; or
(ii) had been referred to the
tribunal and was still being dealt with by the tribunal.
(2) Former chapter 7
, parts 1 and 2 continue to apply in relation to the complaint, and the
complaint must continue to be dealt with under former chapter 7 , parts 1 and
2 , as if the amendment Act had not been enacted.
(3) Subsection (2) does not
prevent the commissioner giving directions under former section 150 , or the
tribunal giving directions under section former 198, that allows for the
complaint to be dealt with in a way that is consistent with this Act as in
force from the commencement.
