ADOPTION ACT 2009 - SECT 131
Aboriginal or Torres Strait Islander children
131 Aboriginal or Torres Strait Islander children
(1) This section applies if the chief executive is making a decision about the
person’s suitability to be an adoptive parent of a child who is, or children
who include, an Aboriginal or Torres Strait Islander child.
(2) The chief
executive must have regard to the person’s ability and willingness to— (a)
help the child to maintain contact with the child’s community or language
group; and
(b) help the child to develop and maintain a connection with the
child’s Aboriginal tradition or Island custom; and
(c) preserve and enhance
the child’s sense of Aboriginal or Torres Strait Islander identity.
(3) If
the chief executive is making a decision about the person’s suitability to
be an adoptive parent of a particular Aboriginal or Torres Strait Islander
child, the chief executive must have regard to the person’s links with, and
standing in, the child’s community or language group.
