Application for final adoption order if interim order is in force
187 Application for final adoption order if interim order is in force
(1) This section applies if an interim order is in force and the child has
been in the custody of the prospective adoptive parents under the order for at
least 1 year.
(2) The chief executive may apply to the Childrens Court for a
final adoption order for the adoption of the child by the prospective adoptive
parents.
(3) The chief executive must serve a copy of the application on the
prospective adoptive parents.
(4) The prospective adoptive parents may apply
to the court for a final adoption order if— (a) the child has been in their
custody under the interim order for at least 1 year and 30 days; and
(b) the
chief executive has neither applied for a final adoption order nor applied to
discharge the interim order.
(5) If the prospective adoptive parents apply
for a final adoption order, they must serve a copy of the application on the
chief executive.
(6) A person served with a copy of the application under
subsection (3) or (5) is a respondent in the proceeding.
