ADOPTION ACT 2009 - SECT 303
Giving or receiving consideration
303 Giving or receiving consideration
(1) A person must not give or receive, or agree to give or receive, a payment
or other reward in consideration of— (a) the adoption or proposed adoption
of a child; or
(b) the giving of consent to the adoption of a child; or
(c)
the transfer of a child’s care or custody with a view to the child’s
adoption; or
(d) a negotiation or arrangement for a child’s adoption.
Penalty— Maximum penalty— (a) for an individual—150 penalty units
or 18 months imprisonment; or
(b) for a corporation—1,000 penalty units.
(2) Subsection (1) applies before or after the birth of the relevant child.
(3) It is immaterial whether the adoption happens or may lawfully happen.
