Notice and taking of effect of proposed action decision
78 Notice and taking of effect of proposed action decision
(1) The chief executive must, as soon as practicable after making a decision
under section 77 , give the person an information notice about the decision.
(2) The decision takes effect on the later of the following— (a) the day the
notice is given to the holder;
(b) a later day of effect stated in the
notice.
(3) However, if the decision was to cancel or suspend the
registration because of a conviction, the cancellation or suspension— (a)
does not take effect until— (i) the period to appeal against the conviction
ends; and
(ii) if an appeal is made against the conviction—the appeal is
finally decided or is otherwise ended; and
(b) has no effect if the
conviction is quashed on appeal.
