ABORIGINAL CULTURAL HERITAGE ACT 2003 - SECT 113
Sponsor may refer plan to Land Court after failure to agree
113 Sponsor may refer plan to Land Court after failure to agree
(1) This section applies if— (a) there is at least 1 endorsed party for the
cultural heritage management plan; and
(b) the consultation period for the
plan has ended; and
(c) all consultation parties have not agreed that the
chief executive may approve the plan.
(2) The sponsor for the plan may refer
the plan to the Land Court and ask the Land Court to approve the plan.
(3)
The sponsor must ensure that a referral of the plan to the Land Court happens
within a reasonable time after the end of the consultation period for the
plan.
