Cancellation of registration and incorporation
105N Cancellation of registration and incorporation
(1) An incorporated association that becomes registered as a co-operative
under the Co-operatives National Law (Queensland) must surrender its
certificate of incorporation under this Act or, if the certificate has been
lost, stolen or destroyed, give to the chief executive a statutory declaration
stating it has been lost, stolen or destroyed.
(2) On receipt of the
certificate of incorporation or a statutory declaration satisfying the chief
executive that the certificate has been lost, stolen or destroyed, the chief
executive must— (a) cancel the incorporated association’s registration;
and
(b) cancel the incorporated association’s certificate of incorporation;
and
(c) give the registrar all records about the former incorporated
association in the chief executive’s possession.
