Lessor’s options if Land Court decides lease may be forfeited
131 Lessor’s options if Land Court decides lease may be forfeited
(1) If the Land Court decides a home ownership lease may be forfeited, the
lessor may— (a) if the proposed forfeiture is subject to conditions decided
by the court—forfeit the lease under this subdivision if the conditions of
forfeiture are satisfied; or
(b) otherwise—forfeit the lease under this
subdivision.
(2) If the proposed forfeiture is because of a breach of a lease
condition, the lessor may decide not to forfeit the lease and instead allow
the lease to continue subject to the lease being amended to include conditions
agreed between the lessor and the lessee.
