Extension of term of lease if proposed forfeiture
133 Extension of term of lease if proposed forfeiture
(1) This section applies to a home ownership lease if— (a) a proposed
forfeiture of the lease has been referred to the Land Court; and
(b) after
the referral but before the Land Court decides on the matter, the term of the
lease would, but for subsection (2) , end.
(2) The term of the lease is taken
to continue until— (a) if the lease is forfeited—the forfeiture of the
lease takes effect as mentioned in section 132 (3) ; or
(b) otherwise—the
end of 60 days after the Land Court makes its decision.
(3) Subsection (2)
applies to the lease despite the provisions of the lease and any other
provision of this Act.
