Preservation of rights
209 Preservation of rights
(1) This section applies if an officer of the public service is appointed as
the chairperson of the Land Tribunal.
(2) The person retains and is entitled
to all rights that have accrued to the person because of employment as an
officer of the public service, or that would accrue in the future to the
person because of that employment, as if service as chairperson were a
continuation of service as an officer of the public service.
(3) If the
person has not attained 65 years of age at the time of the expiry of the
person’s term of office or resignation— (a) the person is entitled to be
appointed to an office in the public service at a salary level not less than
the salary level, at that time, of an office equivalent to the one the person
held before being appointed as chairperson; and
(b) the person’s service as
chairperson is to be regarded as service in the public service for the purpose
of determining the person’s rights as an officer of the public service.
