(1) This section applies if—(a) an emergency situation exists, or is likely to exist, justifying the use of a government building for the situation or likely situation; and(b) the building is structurally adequate and reasonably suitable for the emergency use; and(c) the emergency use is, other than for sections 114 and 115 , lawful.Examples of emergency situation—• a cyclone• local flooding• a dangerous situation under the Petroleum and Gas (Production and Safety) Act 2004
(2) For sections 114 and 115 , the occupation or use of the government building is a reasonable excuse.
(3) Subsection (2) does not limit what may be a reasonable excuse for section 114 or 115 .
(4) In this section—
"government building" means a building owned or occupied by or for the State, including by State instrumentalities and government owned corporations.
