Conduct of specialist mediation and conciliation sessions
259 Conduct of specialist mediation and conciliation sessions
(1) The mediation or conciliation session must be conducted as quickly and
with as little formality and technicality as possible.
(2) A person who is
not a party to the application may attend and take part in the session if the
dispute resolution officer is satisfied the person may help resolve the
dispute.
(3) The session must be held in private.
(4) A person may use an
interpreter in the session.
(5) Evidence of anything said or done about the
dispute in a mediation session is inadmissible in a proceeding.
(6) Evidence
of anything said or done in a conciliation session is inadmissible in a
proceeding, unless the proceeding is an adjudication and the parties have
consented, under section 249 , to the dispute resolution officer conducting
the adjudication.
(7) The mediation or conciliation session may be terminated
at any time by the dispute resolution officer.
