BODY CORPORATE AND COMMUNITY MANAGEMENT ACT 1997 - SECT 453
Dispute resolution in layered arrangement of community titles schemes
(1) This section applies if— (a) before the commencement, a person applied
under former chapter 6, part 4 for the resolution of a dispute about a by-law
made by a body corporate for a community titles scheme in a
layered arrangement of community titles schemes; and
(b) the dispute is
between the person and— (i) the body corporate of another
community titles scheme in the layered arrangement; or
(ii) the owner or
occupier of a lot in another community titles scheme in the
layered arrangement; and
(c) immediately before the commencement, the dispute
is not resolved.
(2) The dispute must be resolved under the Act as if the
Body Corporate and Community Management and Other Legislation Amendment Act 2023
had not been enacted.
