BUILDING INDUSTRY FAIRNESS (SECURITY OF PAYMENT) ACT 2017 - SECT 171
Show cause notice
(1) This section applies if the registrar believes a ground exists to suspend
or cancel an adjudicator’s registration.
(2) The registrar must give the
adjudicator a notice under this section (a
"show cause notice" ).
(3) The show cause notice must state— (a) the action
(the
"proposed action" ) the registrar proposes taking under this division; and
(b) the grounds for the proposed action; and
(c) an outline of the facts and
circumstances forming the basis for the grounds; and
(d) if the
proposed action is suspension of the registration—the proposed suspension
period; and
(e) an invitation to the adjudicator to show within a stated
period (the
"show cause period" ) why the proposed action should not be taken.
(4) The
show cause period must be a period ending at least 21 days after the
show cause notice is given to the adjudicator.
