Witness may be summoned before tribunal
103 Witness may be summoned before tribunal
(1) Upon the request of a person to whom a notice has been given under
section 106 (7) , or the agent of any such person, a tribunal under its hand
may summon any person to attend the tribunal at the time and place specified
in the summons and then and there to give evidence and to produce books,
documents or writings in the person’s custody or control which the person is
required by the summons to produce.
(2) The fee payable for the issue of a
summons is such amount as may be prescribed.
(3) A person served with a
summons under subsection (1) shall not, without reasonable excuse, disobey the
summons. Penalty— Maximum penalty— (a) in the case of a
corporation—13 1 / 3 penalty units; or
(b) in any other case—6 2 / 3
penalty units or 6 months imprisonment.
(4) A person is not bound to
produce any books, documents or writings not specified or otherwise
sufficiently described in the summons or which the person would not be bound
to produce upon a subpoena for production in the Court.
(5) A summons under
subsection (1) need not be obeyed by a person unless the person is tendered
the person’s reasonable expenses for attending the tribunal in accordance
with the summons.
