BUILDING UNITS AND GROUP TITLES ACT 1980 - SECT 127
Service of documents on body corporate, proprietors and others
(1) A summons or other legal process may be served on a body corporate by
leaving it with the chairperson or secretary of the body corporate or with any
member of the committee.
(2) A document other than a document referred to in
subsection (1) may be served on a body corporate— (a) by leaving it with any
person referred to in subsection (1) or in the receptacle provided by the
body corporate in accordance with section 37 (1) (d) ; or
(b) by post on the
body corporate at its address recorded on the registered plan or at the
address of the parcel.
(3) Subject to this Act, a notice or other document
required or authorised by this Act to be served by a referee, a tribunal, a
body corporate, a committee or the secretary of a committee on a proprietor,
lessee, mortgagee or occupier of a lot may be served— (a) by leaving it with
some person apparently of or above the age of 16 years— (i) where the person
to be served is an occupier of the lot—at the lot; or
(ii) where an address
for the service of notices on the person to be served is recorded in the
roll—at the address so recorded; or
(b) by post on the person to be served,
where an address for the service of notices on that person is recorded in the
roll, at the address so recorded; or
(c) in the case of a proprietor—in any
manner authorised by the by-laws for the service of notices on proprietors.
(4) Notice under section 44 (5) may be served on a person— (a) personally or
by post; or
(b) by leaving it with a person apparently of or above the age of
16 years at the place of residence or place of business of the firstmentioned
person.
