Powers of entry of referee in certain cases
129 Powers of entry of referee in certain cases
(1) Where a referee believes on reasonable grounds that— (a) an offence
against any provision of this Act; or
(b) a breach of the by-laws;
has been
or is being committed upon any part of a parcel, the referee may, at any
reasonable time on reasonable notice given to an occupier of that part of the
parcel enter upon that part for the purpose of ascertaining whether that
offence or breach has been or is being committed.
(2) When exercising the
power under subsection (1) , the referee may, if the referee thinks fit, be
accompanied by— (a) the chairperson, secretary or treasurer of the
body corporate or other member of the committee; or
(b) the
body corporate manager (if any) of the parcel concerned.
(3) A person shall
not obstruct or hinder— (a) the referee, in the exercise of the power under
subsection (1) ; or
(b) a person accompanying the referee in pursuance of
subsection (2) .
Penalty— Maximum penalty—2 2 / 3 penalty units.
