COMMERCIAL ARBITRATION ACT 2013 - SECT 20

Place of arbitration (cf Model Law Art 20)

20 Place of arbitration (cf Model Law Art 20)

(1) The parties are free to agree on the place of arbitration (whether in Queensland or elsewhere).
Note—
Subsection (1) is substantially the same as Art 20(1) of the Model Law but is modified to make it clear that the reference to the place of arbitration is not limited by the Acts Interpretation Act 1954 , section 35 to a place in this State.
(2) Failing such agreement, the place of arbitration is to be determined by the arbitral tribunal having regard to the circumstances of the case, including the convenience of the parties.
(3) Despite subsection (1) , the arbitral tribunal may, unless otherwise agreed by the parties, meet at any place (whether or not in Queensland) it considers appropriate for consultation among its members, for hearing witnesses, experts or the parties, or for inspection of goods, other property or documents.
