CRIME AND CORRUPTION ACT 2001 - SECT 146ZO
Misuse of assumed identity
146ZO Misuse of assumed identity
(1) An authorised identity officer commits an offence if— (a) the official
intentionally, knowingly or recklessly acquires evidence of, or uses, an
assumed identity covered by the officer’s authority; and
(b) the official
knows that, or is reckless as to whether, the acquisition or use is not— (i)
in accordance with the officer’s authority; or
(ii) in the course of duty.
Penalty— Maximum penalty—2 years imprisonment.
(2) An authorised
civilian commits an offence if— (a) the person intentionally, knowingly or
recklessly acquires evidence of, or uses, an assumed identity covered by the
person’s authority; and
(b) the person knows that, or is reckless as to
whether, the acquisition or use is not in accordance with— (i) the
person’s authority; or
(ii) the directions of the person’s supervisor
under the authority.
Penalty— Maximum penalty—2 years imprisonment.
(3) This section does not limit section 213 .
