CRIME AND CORRUPTION ACT 2001 - SECT 190
Refusal to answer question
190 Refusal to answer question
(1) A witness at a commission hearing must answer a question put to the person
at the hearing by the presiding officer, unless the person has a reasonable
excuse. Penalty— Maximum penalty—200 penalty units or 5 years
imprisonment.
(2) The person is not entitled— (a) to remain silent; or
(b) to refuse to answer the question on a ground of privilege, other than
legal professional privilege.
(3) If— (a) the person refuses to answer a
question on the ground the answer to the question would disclose a
communication to which legal professional privilege attaches; and
(b) the
person has no authority to waive the privilege;
the person must, if required
by the presiding officer, tell the officer the name and address of the person
to whom or by whom the communication was made. Penalty— Maximum
penalty—200 penalty units or 5 years imprisonment.
