Appeals
15J Appeals
(1) An affected employer to whom a compliance notice is issued may appeal
against the issue of the notice or the terms of the notice to the industrial
commission.
(2) The procedures for the appeal must be as nearly as possible
the same procedures as the procedures for an appeal under the
Industrial Relations Act 2016 , chapter 11 , part 6 .
(3) In particular, the
appeal— (a) must be started within 21 days after the person is given the
compliance notice; and
(b) does not stay the operation of the notice appealed
against unless the industrial commission otherwise orders.
(4) However, the
industrial commission may extend the time for starting an appeal.
(5) A
defect in the compliance notice does not affect an affected employer’s right
to appeal against the issue of the compliance notice or the terms of the
notice.
