COAL MINING SAFETY AND HEALTH ACT 1999 - SECT 206
Procedure
206 Procedure
(1) When conducting its inquiry, the board of inquiry— (a) must observe
natural justice; and
(b) must act as quickly, and with as little formality
and technicality, as is consistent with a fair and proper consideration of the
issues.
(2) In conducting the inquiry, the board— (a) is not bound by the
rules of evidence; and
(b) may inform itself in any way it considers
appropriate, including by holding hearings; and
(c) may decide the procedures
to be followed for the inquiry; and
(d) must give a person involved in the
serious accident or high potential incident the opportunity of defending all
claims made against the person.
(3) However, the board must comply with this
division and any procedural rules prescribed under a regulation.
(4) The
chairperson of the board presides at the inquiry.
