Stay of operation of decisions
239 Stay of operation of decisions
(1) An Industrial Magistrates Court may stay a decision appealed against to
secure the effectiveness of the appeal.
(2) A stay— (a) may be given on
conditions the court considers appropriate; and
(b) has effect for the period
stated by the court; and
(c) may be revoked or amended by the court.
(3) The
period of a stay given by the court must not extend past the time when the
court decides the appeal.
(4) An appeal against a decision does not affect
the operation or carrying out of the decision unless the decision is stayed.
