339 Dealing with charges of offences against Act in summary way before
Magistrates Court
(1) New section 255 applies in relation to a proceeding for an offence against
this Act started after the commencement, whether the offence was alleged to
have been committed before or after the commencement.
(2) Without limiting
the Acts Interpretation Act 1954, section 20, a proceeding for an offence
started under former section 255 before an industrial magistrate before the
commencement may be continued before the industrial magistrate after the
commencement despite the amendment of former section 255 by the
Resources Safety and Health Legislation Amendment Act 2024 .
(3) Also, a
person dissatisfied with a decision of an industrial magistrate in a
proceeding mentioned in subsection (2) may appeal to the Industrial Court
under former section 255 despite the amendment of former section 255 by the
Resources Safety and Health Legislation Amendment Act 2024 .
