COAL MINING SAFETY AND HEALTH ACT 1999 - SECT 48C
Industrial manslaughter—employer
48C Industrial manslaughter—employer
(1) An employer for a coal mine commits an offence if— (a) a coal mine
worker— (i) dies in the course of carrying out work at the coal mine; or
(ii) is injured in the course of carrying out work at the coal mine and later
dies; and
(b) the employer’s conduct causes the death of the coal mine
worker; and
(c) the employer is negligent about causing the death of the
coal mine worker by the conduct.
Penalty— Maximum penalty— (a) for
an individual—20 years imprisonment; or
(b) for a body corporate—100,000
penalty units.
Note— See section 261 in relation to imputing to a body corporate
particular conduct of officers, employees or agents of the body corporate.
(2) An offence against subsection (1) is a crime.
