Statutory powers when Sovereign personally in State
39 Statutory powers when Sovereign personally in State
(1) When the Sovereign is personally present in the State, any power under an
Act exercisable by the Governor may be exercised by the Sovereign.
(2) The
Governor has the same powers in relation to an act done, or an instrument
made, by the Sovereign under this section as the Governor has in relation to
an act done, or an instrument made, by the Governor himself or herself.
(3)
This section does not affect or prevent the exercise of any power under an Act
by the Governor.
(4) In this section, references to the Governor or to the
Sovereign include references to the Governor, or to the Sovereign, acting with
the advice of Executive Council.
