Court to ensure parties understand proceeding
106 Court to ensure parties understand proceeding
(1) In a proceeding for a child, the Childrens Court must, as far as
practicable, ensure the child’s parents and other parties to the proceeding
(including the child if present) understand the nature, purpose and legal
implications of the proceeding and of any order or ruling made by the court.
(2) If the child, parent of a child or other party to a proceeding has a
difficulty communicating in English or a disability that prevents him or her
from understanding or taking part in the proceeding, the Childrens Court must
not hear the proceeding without an interpreter to translate things said in the
proceeding or a person to facilitate his or her taking part in the proceeding.
