12 What is effect of custody
(1) This section applies if— (a) an authorised officer or police officer
takes a child into the chief executive’s custody; or Note— Under
section 18 , a child at immediate risk of harm may be taken into custody.
(b) the chief executive has custody of a child under a care agreement; or
(c)
the chief executive or someone else is granted custody of a child under an
assessment order, temporary custody order or child protection order.
(2) The
chief executive, or other person granted custody of the child, has— (a) the
right to have the child’s daily care; and
(b) the right and responsibility
to make decisions about the child’s daily care.
