Effect of failure to decide application for, or for renewal of, authority
143 Effect of failure to decide application for, or for renewal of, authority
(1) If the chief executive fails to decide an application for an authority
within 90 days after it is properly made— (a) the chief executive is taken
to have decided to refuse the application; and
(b) the applicant is taken to
have received notice of the decision at the end of the time.
(2) If an
application is properly made for renewal of an authority, the authority is
taken to continue to have effect from the day that it would, apart from this
subsection, have ended until the application is decided.
(3) However, if the
application is refused, the authority continues to have effect until notice of
the decision is given to the applicant.
(4) Subsection (1) is subject to
section 143A .
(5) Subsection (2) does not apply if the authority is earlier
suspended or cancelled.
