Ordinary protection and immunity allowed
52 Ordinary protection and immunity allowed
(1) In performing the functions of an ADR convenor under a referring order,
the ADR convenor has the same protection and immunity as a Supreme Court judge
performing a judicial function.
(2) A party attending an ADR process has the
same protection and immunity the party would have if the ADR process were a
proceeding being heard before the court.
(3) A witness attending an
ADR process has the same protection and immunity as a witness attending before
the court.
(4) A document produced at, or used for, an ADR process has the
same protection during the ADR process it would have if produced before the
court.
(5) In subsection (2) —
"party" includes a party’s lawyer or agent.
