Amendment—grounds
84 Amendment—grounds
(1) The chief executive may amend an allocation notice, including, for
example, by adding a further condition to the notice— (a) with the written
agreement of the holder of the notice; or
(b) if the chief executive is
satisfied, or reasonably believes, the amendment is necessary or desirable for
coastal management.
(2) Without limiting subsection (1) , if an allocation
notice holder removes quarry material at a rate less than 50% of the maximum
rate stated in the notice, the chief executive may amend— (a) the total
quantity of material permitted to be removed under the notice; or
(b) the
maximum rate.
(3) However, an amendment under subsection (1) must not
increase the period for which the notice has effect.
