DOMESTIC AND FAMILY VIOLENCE PROTECTION ACT 2012 - SECT 45
Matters court must be satisfied of
45 Matters court must be satisfied of
(1) A court may make a temporary protection order against a respondent only if
the court is satisfied that— (a) a relevant relationship exists between the
aggrieved and the respondent; and
(b) the respondent has committed
domestic violence against the aggrieved.
(2) Subsection (1) does not apply if
the court makes a temporary protection order under section 44 (1) (b) .
(3)
In deciding whether to make a temporary protection order, the court may
consider the respondent’s criminal history and domestic violence history if,
in the court’s opinion, it is relevant to do so.
