Impersonating debt collectors
38 Impersonating debt collectors
(1) A creditor, when dealing with a person for payment of a debt, must not use
any name, description, document or device intended to make the person believe
that the person is not dealing directly with the creditor, but with a debt
collector acting on the creditor’s behalf. Penalty— Maximum
penalty—200 penalty units or 2 years imprisonment.
(2) A debt collector
must not give any document to a creditor to enable the creditor to make a
third person believe that the third person is dealing directly with the debt
collector. Example for subsection (2)— debt collector’s letterhead or
stationery
Penalty— Maximum penalty—200 penalty units or 2 years imprisonment.
