Identification of persons or things by affected child
21AT Identification of persons or things by affected child
(1) This section applies if an affected child is required to identify a
person, including the defendant, or thing when the child is giving evidence.
(2) The court may make the orders it considers appropriate to ensure that the
identification is carried out in a way that limits the distress or trauma that
might be suffered by the child when making the identification. Note— See
section 9E for the general principles to be applied when dealing with a child
witness.
(3) The court must also decide at what point during the giving of
the child’s evidence the identification is to be made.
(4) If an affected
child is required to be in the defendant’s presence for the purposes of
identification, the child should not be required to be in the defendant’s
presence for the identification for any longer than is necessary.
