Court to give directions about the use or safekeeping of a recording
21AZA Court to give directions about the use or safekeeping of a recording
(1) The presiding judicial officer may make any order the judicial officer
considers appropriate about the use or safekeeping of a recording.
(2)
Without limiting subsection (1) , the presiding judicial officer may give
directions, with or without conditions, as to— (a) the persons, or classes
of persons, who are authorised to have possession of a recording; and
(b) the
giving up of possession of a recording.
(3) The presiding judicial officer
must have regard to the following matters when deciding the persons, or
classes of persons, who are authorised to have possession of a recording—
(a) the need for counsel involved in the proceeding to have access to the
recording;
(b) the need to ensure that persons authorised to have possession
of the recording are able to take appropriate measures to ensure there is no
unauthorised access to the recording.
(4) In this section—
"use" , of a recording, includes copying of the recording.
