EXPLOSIVES ACT 1999 - SECT 59B
Warning to be given by inspector
59B Warning to be given by inspector
(1) Before requiring a person to answer a question under section 59 , an
inspector must— (a) warn the person that failure to answer the question
without reasonable excuse would constitute an offence; and
(b) warn the
person about the effect of section 59A .
(2) It is not an offence for an
individual to refuse to answer a question put by the inspector on the ground
the question might tend to incriminate the individual, unless the individual
was first given the warning mentioned in subsection (1) (b) .
(3) Nothing in
this section prevents an inspector from obtaining and using evidence given to
the inspector voluntarily by a person.
