Power to require attendance of persons before an inspector to answer questions
97 Power to require attendance of persons before an inspector to answer
questions
(1) The chief inspector may require a person to attend before an inspector and
to answer questions— (a) relevant to the discharge of the person’s
obligations under this Act; or
(b) on health, safety or security matters
relevant to explosives; or
(c) to ascertain whether this Act is being
complied with; or
(d) relevant to any action carried out by the inspector
under this Act.
(2) A requirement made of a person under this section to
attend before an inspector must— (a) be made by written notice given to the
person; and
(b) state a reasonable time and place for the person’s
attendance.
(3) When making a requirement under this section, the chief
inspector must warn the person it is an offence to fail to comply with the
requirement, unless the person has a reasonable excuse.
