Information notice about particular decisions
198 Information notice about particular decisions
(1) Subsection (2) applies if the administering authority— (a) decides to
refuse an application; or
(b) decides to impose a condition on an
environmental authority and the applicant has not agreed in writing to the
condition or a condition to the same effect.
(2) The authority must give the
applicant an information notice about the decision.
(3) The information
notice must be given— (a) for a decision mentioned in subsection (1) (a)
—within 10 business days after the decision is made; or
(b) for a decision
mentioned in subsection (1) (b) —when the environmental authority is issued
to the applicant.
(4) If the administering authority decides to approve an
application, it must, within 10 business days after the decision is made, give
any submitter for the application an information notice about the decision.
(5) This section does not apply for a decision about an application for a
mining activity relating to a mining lease.
